These Terms & Conditions ("Terms") govern your access to and use of the VisualsDepot website, platform, services, and any images, videos, or other visual media made available through the platform (collectively, the "Services"). By accessing, browsing, registering, purchasing, downloading, or using any part of the Services, you agree to be legally bound by these Terms. VisualsDepot is a digital stock media platform that provides licensed images, videos, and visual content for commercial and non-commercial use, subject to applicable license agreements. VisualsDepot acts solely as a licensor of content and does not transfer ownership of any intellectual property.
You must be at least eighteen (18) years of age to create an account or make purchases on VisualsDepot. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, whether authorized or unauthorized.
All images, videos, and other visual media available on VisualsDepot ("Content") are licensed, not sold. Use of any Content is governed strictly by the VisualsDepot Standard License Agreement or any other license explicitly stated at the time of download. Downloading, accessing, or using Content constitutes your acceptance of the applicable license terms. Ownership, copyright, and all intellectual property rights in the Content remain with VisualsDepot or its licensors.
You agree to use the Services only for lawful purposes and in compliance with these Terms and all applicable laws and regulations. You must not misuse the platform, attempt unauthorized access, interfere with system security, scrape or harvest content, or disrupt the normal functioning of the Services.
You must not resell, redistribute, sublicense, share, or make available Content as standalone files; upload Content to any competing stock media platform or asset library; claim ownership or authorship of Content; use Content in logos, trademarks, or brand identities; imply endorsement by VisualsDepot or any depicted individual; or use the Services in connection with illegal, misleading, defamatory, hateful, or harmful activities.
VisualsDepot does not guarantee that all Content includes model releases or property releases. You acknowledge and agree that you are solely responsible for determining whether releases are required for your intended use and for obtaining any necessary permissions, consents, or licenses prior to use.
All prices, subscription plans, and billing terms are displayed on the VisualsDepot website and may be updated at any time. Payments must be made in advance and are non-refundable unless explicitly stated otherwise. VisualsDepot reserves the right to suspend or terminate access to the Services in the event of non-payment, chargebacks, or payment disputes.
All website design, layout, text, graphics, logos, trademarks, software, and platform features are the exclusive intellectual property of VisualsDepot. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Services without prior written consent from VisualsDepot.
The Services may contain links to third-party websites or services. VisualsDepot does not control and is not responsible for the content, policies, or practices of any third-party sites. Accessing third-party services is done at your own risk
The Services and Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or availability
To the maximum extent permitted by law, VisualsDepot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services or Content. In no event shall VisualsDepot’s total liability exceed the amount paid by you to VisualsDepot in the twelve (12) months preceding the claim.
VisualsDepot may suspend or terminate your account or access to the Services at any time if you violate these Terms or applicable license agreements. Upon termination, you must cease using the Services. License rights already granted remain subject to the applicable license terms unless terminated due to breach.
VisualsDepot reserves the right to modify or update these Terms at any time. Updated Terms will be posted on the website with a revised "Last Updated" date. Continued use of the Services after such changes constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of India.
